Dear OpenAI Team,
This is to put on record that my prepaid API credits expired without any prior notification or warning, which is a direct violation of consumer protection standards. My account details clearly state:
Received: Apr 21, 2024
State: Expired
Balance: $0.00 / $50.00
Expires: May 01, 2025
At no point was I notified via email regarding the impending expiry of these prepaid credits.
As per the Reserve Bank of India (RBI) Master Directions on Issuance and Operation of Prepaid Payment Instruments (PPIs), 2021, clause 7.9.2 (vi):
“Issuers shall caution the holders of PPIs at reasonable intervals, during the 30 days prior to the expiry date of the PPI, through SMS / email / post or by any other means in clear terms, about the expiry of the PPI.”
These directions are issued under the Payment and Settlement Systems Act, 2007. Failure to provide such mandatory notification amounts to deficiency of service and unfair trade practice, exposing the issuer to legal liability under the Consumer Protection Act, 2019.
I demand the following within 7 days of receipt of this notice:
1. Immediate reinstatement of my expired prepaid credits or equivalent refund.
2. Written explanation for the lack of notification.
3. Clear corrective measures to prevent recurrence.
If this issue is not resolved promptly, I will be compelled to initiate proceedings before the RBI Ombudsman and also file a formal complaint under the Consumer Protection Act, 2019, seeking compensation for deficiency of service and financial loss.
AND NO! YOUR POLICIES OR TERMS AND CONDITIONS CANNOT OVERRIDE MY LEGAL RIGHTS.
