Future AI Image Problems: DMCA Conflicts with OpenAI Policy on Canon Characters"

Hello OpenAI team and community,

I am writing to address a major future problem that will affect AI-generated images of canon characters due to the conflict between OpenAI’s policy and real copyright enforcement like DMCA.

The Current Issue

  1. OpenAI’s AI policy does not allow generating canon characters.

This means no Pokémon, Mario, or any copyrighted character can be generated.

  1. Nintendo (and other companies) are enforcing stricter copyright policies.

They now require that only exact official character designs are allowed under DMCA.

No altered versions, no “inspired by” creatures (because of “Palworld” legal concerns).

  1. This creates an unsolvable conflict.

AI refuses to generate canon characters (even when DMCA allows it).

AI also refuses to generate alternate versions (because companies like Nintendo ban them).

This results in a complete restriction on AI-generated content, with no solution for artists or fans.

Why This Will Be a Huge Problem in the Future

More companies will follow Nintendo’s strict copyright policies.

If AI continues to block canon characters, it will become completely unusable for fandom and creative projects.

No legal way to create AI-generated fan content.

If AI refuses to follow DMCA-compliant image generation, no one will be able to generate fandom content legally.

AI-generated images will become more restricted over time.

If OpenAI keeps blocking everything copyrighted, then eventually AI won’t be able to generate anything with recognizable designs.

Creators, fans, and artists will suffer the most.

Many people rely on AI for creating fan art, but if both canon and alternate characters are blocked, there will be no way to create content at all.

The Urgent Need for AI Policy Change

To avoid these future issues, OpenAI must update its AI policy to reflect DMCA law properly. This means:

  1. Allowing canon character generation only when it follows DMCA compliance (e.g., original designs, proper credit).

  2. Clarifying why AI blocks all canon characters, even when DMCA allows them.

  3. Ensuring that AI does not become completely restricted, losing its ability to generate legally compliant images.

Final Thoughts: The Future of AI-Generated Content Is at Risk

If OpenAI does not address this, AI-generated content will become so restricted that it will be nearly useless for artists, fans, and digital creators. Fandom communities will suffer, and AI will fail to adapt to modern copyright laws like DMCA.

I would like OpenAI’s official response on how they plan to handle this growing problem in the future. If AI does not evolve to comply with DMCA-compliant image generation, it will cause serious issues for the entire digital art community.

What is OpenAI’s stance on this future conflict? Will AI image generation policies be updated to prevent a complete restriction on canon characters?

Thank you for your time and consideration.
