Do you usually file for a trademark when launching an app? I’m curious about how people in other countries generally perceive this do most developers consider it important?
with or without trademark filing you need to demonstrate prior use so it’s not as powerful a protection as you may think it is. Suggest you do some reading on trademark laws and litigation.
Yeah, I get that the US follows a “first-to-use” principle when it comes to trademarks.
But as far as I know, most other countries operate under a “first-to-file” system,
so registering a trademark can make a big difference depending on your target market.
You should do it. It’s gonna help you protect your brand and avoid future legal headaches. It’s literally worth the investment for peace of mind.
In Australia “prior use” is also the main legal defence, with or without a application it can be argued there has been prior use if the evidence is there. It surprises me (if) there is no international harmony with respect to prior use" defence on something that frequently runs across national boarders. It doesn’t hurt to have trademarks but for small companies. if a big company wants to use names and logos in that space, they pretty much can if you don’t have deep pockets. For something to be considered “new art” in terms of a logo design, a 5-10% change in the artwork is enough.
