You have an interesting question, and one that is mostly addressed in the OpenAI Terms and Conditions,
3. Content
(a) Your Content. You may provide input to the Services (“Input”), and receive output generated and returned by the Services based on the Input (“Output”). Input and Output are collectively “Content.” As between the parties and to the extent permitted by applicable law, you own all Input. Subject to your compliance with these Terms, OpenAI hereby assigns to you all its right, title and interest in and to Output. This means you can use Content for any purpose, including commercial purposes such as sale or publication, if you comply with these Terms. OpenAI may use Content to provide and maintain the Services, comply with applicable law, and enforce our policies. You are responsible for Content, including for ensuring that it does not violate any applicable law or these Terms.
and as will take effect January 31:
Ownership of Content. As between you and OpenAI, and to the extent permitted by applicable law, you (a) retain your ownership rights in Input and (b) own the Output. We hereby assign to you all our right, title, and interest, if any, in and to Output.
However, what you cannot do:
- Represent that Output was human-generated when it was not.
So you can make T-shirts of AI cat astronauts and sell them in your store.
The output of AI models was found by the US copyright office, despite being based on human prompting, to not hold the status and protections of copyrightable material, meaning that your AI picture of an alien is basically released into the public domain by its publishing, and that “selling” basically is giving anyone else with the imagery the same ability to publish without them infringing on any copyright or any action you could take.
You also can cajole the AI into making representations that look like other’s copyrighted works, so your AI picture of a lasagna-eating orange cat that appears infringing may still not be able to be sold without upsetting a copyright or trademark owner.
