Yes, but ChatGPT could fix this with a disclaimer that only people of 18+ are able to use it. Which means that if kids under 18 use it with the permission of their parents, are falling under the responsibility of the parents who gave permission for it.
When I have a kid who can use internet, I am not able to sue the internet provider or a porn site when my kid is surfing there. That is my own responsibility as a parent to keep watch over that.

So what about all the 13 and under 17 already users under current tos?
You can if the site says 13+
You know those “we’re changing the terms of service” E-Mails literally every company on earth sends out on a daily basis? Send one of those.

Yes, but these sites are not saying 13+, but 18+.
And so should OpenAI do for using chatgpt.
A very simple way to legally protect yourself.

not trying to argue ., good luck I hope they do what you wish
https://openai.com/policies/row-terms-of-use/?utm_source=chatgpt.com
“ Registration and access
Minimum age. You must be at least 13 years old or the minimum age required in your country to consent to use the Services. If you are under 18 you must have your parent or legal guardian’s permission to use the Services.
Registration . You must provide accurate and complete information to register for an account to use our Services. You may not share your account credentials or make your account available to anyone else and are responsible for all activities that occur under your account. If you create an account or use the Services on behalf of another person or entity, you must have the authority to accept these Terms on their behalf.”
Have a good night
Officially, there are no users of 13 and under 17, since every user has to pay with a credit card for which you need to be 18+.
Technically the users are the parents.
It’s a case of accepting a new license agreement, and done.

There is nothing related to this problem that is an insurmountable problem to fix. Right now, people are thinking about ways to avoid making the change many paying customers want rather than thinking of ways to fix it. When you have a “how can we avoid fixing it” culture, your days are numbered.
Because when something similar DOES come along with the option to be treated like an adult, why would I stick with ChatGPT?

They should take away exactly this line. Case solved.

Dialogue is always good my friend.
Staff of OpenAI should start learning to do that too with their users.
Why else do we have this forum here? That is how a community works.
Goodnight.

I´m afraid that is exactly how it is going to be.
But this part gets them sued . It is 13+ content like a kids forum or game snd parent gives child permission to use the 13+ site then it changes to 18+ all those under the old TOS can go after OpenAI
For not warning content is 18+

Absolutely true.
I just say they could solve this issue very easy if they really had the will to it.

A better solution is make ChatGPT adult
A separate thing like plusA

A new service skips the can of worms

Yes, that could be a solution too, and if they had the will to do it, they would have already done so.
They biggest complaints everywhere about chatgpt are related to woke content policies, but OpenAI keeps choosing to stay deaf.

Simply do age verification and have a check box that says “I want to be treated like an adult.” Everyone who does that has ChatGPT Adult.

Again, we’re just thinking of reasons not to do something. It’s a simple matter of putting a check box that says “I want to view adult content.” Then it’s the parents responsibility.
Or, here’s an idea, stop having the internet raise your kids. I’m not paying $20/month for NetNanny.

How do you retroactively do that there is millions of 13+ users who simply got no check box…
you can’t simply rewrite age scale with active users … you can’t change a contract like that…
Truly a separate adult model would be best route new service new contracts, I would pay for 18+ access on an adult model…
I know these are excuses “just do it”
I am just being realistic and I know tos…
This really has not been a conversation… I doubt they will “just do it” you guys should come up with ideas…
Again, there are no legitimate 13-year-old users with Plus because it requires a credit card. Any 13-year-old using Plus is doing so with the explicit permission of their parents.
How do you send an e-mail to 13-million users?
“Hey ChatGPT, type me up an e-mail that notifies users of a change to our terms of service.”
Then click “Send.”
