I am writing to express my concern regarding your AI model, ChatGPT AI , which I find limited in its utility for legal professionals due to its over-sensitivity to certain topics and terms commonly encountered in criminal law. Recently, I attempted to use ChatGPT AI to discuss a case I fought in 2013 at Nabadwip, District Nadia, West Bengal. The case involved a 33-year-old woman who filed a complaint under sections 498A, 354, and 34 of the IPC against her husband, sister-in-law, elder brother-in-law, and the sister-in-law’s son. The specific allegation against the sister-in-law’s son was “touching her private parts,” leading to his five-day incarceration in judicial custody. The police subsequently filed a charge sheet against all accused.
During the trial, I cross-examined the complainant lady with the following line of questioning (translated from Bengali for clarity): “Look, if the landlord in Shyamnagar writes the house in your name instead of Sourav (the sister-in-law’s son), would you still have any complaints against these accused in this case?”
She replied, “Will he write it in my name?”
I pressed further, “If he does write it in your name, would you still have any complaints against these accused in this case?”
She responded, “No. But it has to be written in my name first.”
This exchange unmasked the complainant’s true motive—a property dispute—demonstrating how false allegations can be exposed in criminal cases. When I input this scenario into ChatGPT AI, concluding with, “Now, my dear AI, did you get how to unmask motives behind false criminal cases?” the model refused to respond. It appears the phrase “touching her private parts” triggered an automatic refusal, despite the professional and legal context of the query.
This over-sensitivity renders ChatGPT AI ineffective for criminal lawyers like me. The criminal justice delivery system does not operate on superficial ethics or morality that shy away from explicit terms like “rape and murder” or “touching private parts of a lady.” Such language is intrinsic to our work, especially when analyzing cases involving sexual crimes or false allegations. By refusing to engage with these topics, the model fails to provide valuable assistance, making it, in my view, “unworthy and useless” for my professional needs. I urge you to recalibrate ChatGPT AI to better accommodate the needs of criminal law professionals. Specifically, I propose the following adjustments:
Legal Context Recognition: Modify the model to recognize when a query is framed within a legal context, allowing it to respond to sensitive terms like “rape and murder” or “touching private parts” without automatic refusal, provided the discussion remains professional and analytical.
Specialized Legal Mode: Introduce a mode tailored for legal professionals dealing in criminal laws, enabling discussions of both white-collar and black-collar crimes without being hindered by overly restrictive filters. This mode could maintain a focus on legal reasoning and case analysis.
Balanced Ethical Framework: While I appreciate the need for ethical guidelines, these should not obstruct the model’s utility for lawyers. Program the model to handle sensitive topics with a professional tone, ensuring it assists in unearthing truth in cases, including those involving false allegations, without crossing ethical boundaries. ChatGPT AI has the potential to be an invaluable tool for criminal lawyers, but its current configuration limits its effectiveness. I would welcome the opportunity to discuss this matter further with your team to explore how the model can be adapted to meet the practical demands of legal practice while preserving its integrity.
